In the past few years, our firm resolved a case involving an individual who had been denied employment with a six-figure salary because the background check told the employer that our client had an active warrant for their arrest. This information was incorrect.
Common Errors in Background Checks
Mistakes on background checks can cause you to be denied credit, housing, or employment. Below are the three most common background check errors:
- Incorrect Criminal Record
- Outdated Information that should no longer be reported
- Mistaken Identity, the criminal record of someone else is on your background check
Any of these mistakes can be detrimental to a consumer and could cost them their current or future job.
Checkr the Background Check Company
Checkr is a Silicon Valley backed company that handles background checks for major companies like Uber and Lyft. The Fair Credit Reporting Act (FCRA) requires Checkr to complete these records with “maximum possible accuracy.” Along with keeping up with background checks (roughly 1.5 million per month).
Since 2015, Checkr alone has faced at least 80+ lawsuits under the Fair Credit Reporting Act. Uber, which uses Checkr for all their employment background checks, is now the center of a recently filed class action lawsuit.
This new lawsuit alleges that Ubers use of Checkr for background checks discriminates against drivers by using their criminal history reports to determine workability.
