In 2012, Edward Maginnis and Shawn Howard represented the father of a young man killed in a drunk driving automobile accident. The young man had been a passenger in the car of the drunk driver when he went across the center line and crashed in a ditch. He was killed instantly. The case was rejected by several of Raleigh’s most established personal injury litigation firms because of concerns that the young man had been “contributorily negligent” for voluntarily riding in a vehicle with an intoxicated driver. Through several depositions, we were able to show that it was possible that the driver had not exhibited any signs of intoxication and our client was not aware that he was under the influence.
