Maginnis Howard, PLLC’s wage and hour attorneys represent employees unlawfully denied compensation from their employers. Our attorneys are experienced in the various laws governing minimum wage, overtime wages, and other unpaid wages (vacation pay, bonuses, commissions, sick pay, and paid time off), including the North Carolina Wage and Hour Act (NCWHA) and the Fair Labor Standards Act (FLSA)

Recently, Several former employees at Bowes In Home Care in Illinois said they were promised back pay, but they still haven’t received the wages. The Illinois Department of Labor confirmed they’re reviewing 22 wage complaints about the home health care provider. Similarly, Bouchard Transportation is facing a lawsuit brought on behalf of several Bouchard mariners who assert that they have not been paid for any work they have performed this year.

Under North Carolina law, a prevailing employee represented by an attorney in an unpaid wages/salary lawsuit may be able to recover his reasonable attorneys’ fees, court costs, and interest. Furthermore, because bonuses are “wages” under the NCWHA, a prevailing plaintiff can be awarded twice the amount of unpaid wages as “liquidated damages.” Thus, if an employee is owed $15,000 in wages, a judge can award the employee $30,000, plus attorneys’ fees and costs

We have successfully represented workers in an extensive range of industries throughout North Carolina with a range of wage and hour issues, including unpaid wages, overtime issues, work breaks, and prevailing overtime misclassification cases. Our attorneys would love the opportunity to assist you in obtaining fair compensation. We typically accept these cases on a contingency basis, meaning no attorney fees are owed unless we recover something for you and/or your fellow employees.
