Car Accident in a Lyft Vehicle

In many ways, the fact that you are a passenger in or the driver of a Lyft vehicle does not change your rights. If you are injured because of someone’s negligent driving, whether the Lyft driver or the driver of another vehicle involved in a collision with the Lyft car, you have a right to pursue a bodily injury negligence claim. In that claim, you can seek to recover all of your relevant financial losses and physical harms, including: medical expenses and lost wages and compensation for any physical pain, mental suffering, permanent injury, disfigurement or scarring, and loss of use.

Lyft Driver Insurance

However, there is one key way that Lyft claims can be a bit different than your average automobile accident case. That key way is that there will be, generally, more than enough insurance coverage to pay for all your losses. In North Carolina, many motorists only carry the minimum limits of $30,000 per person automobile bodily injury liability coverage. That means that even if there is a wrongful death or catastrophic injury, the family of the deceased or the serious injured person will, most of the time, only recover $30,000. However, when a Lyft driver has passengers in his vehicle, Lyft provides $1,000,000 of total bodily injury coverage. This is a key difference.

The Lyft automobile policy insures not only the passengers but also the driver, if he is carrying passengers at the time. For example, assume an at-fault driver rear-ends a Lyft vehicle while there is 1 passenger. Assume also that both the Lyft driver and his/her passenger sustain serious injuries. Once the at-fault driver’s policy pays out in full, they will each likely have “Underinsured Motorist (UIM) coverage” through Lyft’s automobile insurance policy.
