Thousands of United States Postal Service (USPS) trucks operate every day on North Carolina roads. The employees who operate these trucks can drive negligently and cause serious automobile collisions just like anyone else. The postal service does not insure its vehicles through private insurance companies. Instead, it pays claims directly to the federal government. One of the ways to initiate a claim with the Government is to contact a regional Tort Claims Investigative unit. For claims in Raleigh, the nearest Investigative unit is the Greensboro District. The Tort Claims Investigative unit will require the claimant to fill out a Form 95.
Submitting Form 95
As part of the form submission, the Post Service may insist on a medical report from your physician or surgeon. Some of the information that will need to be in the report, include:
- Your name, age and address;
- The history of your medical condition and date and history of the subject automobile crash as described by you to your physician or surgeon;
- Results of any X-Rays, CT Scans, or MRIs performed and the date taken;
- Your precise diagnosis, including the character and extent of your injuries;
- Any contributing factors, including whether you have any pre-existing conditions that bear on your alleged current injury; and,
- Your prognosis, including the length of time of any partial disability and extent of such disability.
Medical records and medical bills, along with any lost wage documentation, should accompany the report by your physician. Additionally, the USPS may require that any property damage claim must be resolved concurrently with your injury claim. If you and the Government cannot agree on an amount of compensation, you will have the right to file a Federal lawsuit against the Postal Service. You may not file in state court, as you can with most other automobile wrecks.
