Most architects are smart enough not to try to “reinvent the wheel” and do not draft their own contracts. Consequently, the majority of architect contracts are simply a tailored version of a form provided by the AIA. As a result, there are a number of reoccurring legal issues that must be dealt with in most architectural disputes. For collections on unpaid balances, an example would be the clause pertaining to “Termination Expenses” found in many AIA contracts. This clause entitles an architect to certain liquidated damages when a contract has been terminated through no fault of his own. Depending upon the exact AIA contract and phase, the liquidated damages could be a bonus of as much as 20%.
